INNOV8 MMA — Terms & Conditions

These Terms govern your access to INNOV8 MMA’s facilities, classes, events, retail, website(s), and mobile/online services (the “Services”). We use PushPress for account management, digital documents/waivers, class scheduling, check‑ins, waitlists, and billing. By visiting our premises, creating a PushPress account, booking a class, or paying any fee, you agree to these Terms, our Privacy Policy, and PushPress’ Terms and Privacy Policy as they apply to your app/portal use. 1) Eligibility, Accounts & PushPress Access
Age. You must be 18+ to enter a membership contract. Minors may participate only with parent/guardian consent as required by our policies.
Account creation (PushPress). You must maintain an active PushPress account (Members App or web portal) with accurate profile and payment details. You are responsible for all activity on your account and for safeguarding your login. The PushPress Member App lets you reserve classes and manage your account. PushPress+1
Health & capability. You confirm you are fit for high‑intensity/contact sports and will notify us of health changes.
2) Memberships, Billing & Payments (via PushPress/Stripe)
Types. We may offer: Month‑to‑Month, Fixed‑Term (e.g., 3/6/12 months), Prepaid, Class Packs, Drop‑In, Family/Student/Corporate, and Competition Team add‑ons.
Auto‑renewal. Unless stated otherwise, recurring memberships auto‑renew until canceled under Section 3.
Payments. Billing is handled through PushPress, which processes payments using Stripe. You authorize recurring charges to your stored payment method for dues/fees/taxes. Keep a valid card/bank account on file to avoid service suspension and late fees. PushPress Help Center+1
Invoices. Some invoices are paid automatically via your stored method inside PushPress; payment via the Members App may be limited, so ensure your payment method stays current. PushPress Help Center
Price changes. We may adjust prices on renewal with [30] days’ notice (email/app).
Refunds. Except where required by law or stated in an offer, fees are non‑refundable once a term starts or a class pack is activated.
Holds. Eligible plans may be placed on hold for [up to 2 weeks per 12 months] (medical/travel/hardship). A freeze fee of 200BHT may apply; request [3 business days] before your next bill and provide documentation.
Chargebacks. Disputes should come to us first. Unauthorized chargebacks may lead to suspension and recovery where lawful.
3) Cancellations & Termination (incl. PushPress “Click‑to‑Cancel”)
Your cancellation request path. You may request cancellation inside the PushPress Members App using Click‑to‑Cancel. Requests route to our dashboard for processing (they are not auto‑processed), and our notice windows/fees still apply. Submit requests before your next bill date to avoid renewal. Notice requirements.
Month‑to‑Month: Cancel any time with written/app notice before your next bill.
Fixed‑Term: Early termination only for qualifying reasons (e.g., relocation [>25 miles/40 km] or medical restriction [>3] months) with proof; an early termination fee of [lesser of 10X or Y% of remaining dues] may apply.
Our termination. We may suspend/terminate for non‑payment, unsafe conduct, policy violations, or misuse. Pro‑rated refunds only where required by law.
Cooling‑off (online sales). If applicable by law, you may have a statutory cooling‑off period; see Schedule E.
4) Class Booking, Waitlists & Check‑Ins (PushPress)
Booking. Reserve classes in the PushPress Members App or web portal within our booking windo
Waitlists. If a class is full, join the waitlist in the app. When space opens (if enabled), PushPress may automatically add you and notify you; you must cancel promptly if you can’t attend to avoid late/no‑show penalties. PushPress Help Center
Check‑ins. Use the PushPress Members App to check in upon arrival so attendance is recorded. Staff may require additional verification. PushPress Help Center+1
Late cancel / no‑show. Cancel ≥ [1] hours before class to avoid a loss of a credit. Repeated no‑shows within [30 days] may limit booking privileges.
Sparring & advanced drills. Coach approval and required protective gear; follow contact‑level rules.
5) Facility Use & Conduct
Code of conduct. Zero tolerance for harassment, bullying, discrimination, or unsafe behavior. Follow staff instructions at all times.
Hygiene. Clean attire, nails trimmed, wounds covered; footwear off mats; disinfect gear after use.
Property. Use equipment properly. We are not responsible for lost/stolen items; lockers are at your risk.
Prohibited. Weapons, illegal substances, alcohol, and performance‑enhancing drugs are prohibited.
Minors. Follow child‑safety rules; non‑training minors must remain with a supervising adult.
Closures/changes. Schedules, instructors, or programming may change; temporary closures may occur.
6) Health, Safety, Assumption of Risk & Release
Inherent risks. Martial arts/combat sports and strength & conditioning involve risks including sprains, fractures, infections, concussion, and other serious injury.
Medical clearance. Consult your physician before participating. Do not train under the influence, when ill/contagious, or with open wounds.
Assumption of risk. To the maximum extent permitted by law, you assume all risks from participation and facility use.
Waiver & release. To the maximum extent permitted by law, you release INNOV8 MMA and its owners/staff/contractors from claims arising from ordinary negligence (not gross negligence/willful misconduct).
Emergency care. You consent to first aid/emergency treatment and accept related costs.
Digital waivers & contracts (via PushPress). You will sign waivers, policies, PAR‑Q, and membership agreements digitally through PushPress. PushPress automatically appends signature/date, and you may be asked to check additional agreement boxes for legal defensibility. PushPress Help Center+2PushPress Help Center+2
7) Personal Training, Coaching & Private Sessions
Only INNOV8 MMA‑approved coaches may provide instruction on premises.
Private sessions follow coach availability and 24‑hour cancellation rules.
Coaching advice is fitness/skills‑related and not medical advice.
8) Retail & Online Store
Orders. We may limit quantities; acceptance occurs on dispatch confirmation.
Shipping & risk. Risk passes on delivery to the carrier unless law states otherwise.
Returns. Retail items may be returned within [30] days if unused and in original packaging, except final‑sale/hygienic items (mouthguards, groin guards, etc.).
Manufacturer warranties. Third‑party products carry their manufacturer’s warranties, if any.
9) Intellectual Property & Content
Our IP. Training materials, class names, logos, videos, and content are ours or licensed to us. Do not record/distribute classes without written permission.
Your content. You grant us a non‑exclusive, worldwide, royalty‑free license to use reviews/posts you submit in connection with the Services, subject to our Privacy Policy.
Name, image, likeness. See Schedule D – Media Consent for promotional usage and opt‑outs.
10) Privacy & Communications (INNOV8 MMA + PushPress)
Data sharing with PushPress. We share necessary personal data with PushPress (and their service providers) to operate scheduling, check‑ins, documents, billing, and communications. PushPress states it acts as a service provider to clients (like us) under certain laws and may send direct SMS notifications or other communications in line with its privacy policy. PushPress
Marketing consent. You can opt in to INNOV8 MMA email/SMS marketing and opt out at any time (reply STOP for SMS or use unsubscribe links). Transactional messages (e.g., receipts, schedule updates, cancellation confirmations) will still be sent by us and/or PushPress. PushPress

11) Third‑Party Services — PushPress
Separate terms. Your use of the PushPress Members App/portal is also governed by PushPress’ Terms of Service/Use and Privacy Policy. Features and availability are controlled by PushPress and may change, face downtime, or be discontinued by PushPress. PushPress
Feature changes/downtime. PushPress may change, suspend, or discontinue features or impose downtime/maintenance; we are not liable for such changes or outages. PushPress
Integrations. PushPress integrates with third‑party services (e.g., Stripe for payments); their terms apply where you interact with them. PushPress Help Center+1
12) Disclaimers, Limitation of Liability & Indemnity
No warranties. Services are provided “as is” and “as available.”
Limitation of liability. To the maximum extent permitted by law, our total liability for any claim relating to the Services is limited to the amount you paid us in the 12 months before the event or [$X], whichever is less. This does not limit non‑waivable rights.
Indemnity. You agree to indemnify INNOV8 MMA from third‑party claims arising from your breach of these Terms, misuse of Services, or negligent acts/omissions.
13) Suspension & Refusal of Service
We may immediately suspend or refuse service if your conduct is unsafe, disruptive, abusive, or otherwise violates these Terms or our Gym Rules.
14) Dispute Resolution & Governing Law
Governing law. These Terms are governed by the laws of Thailand.
Good‑faith resolution. Contact us to attempt informal resolution within [30] days before filing a claim.
Arbitration (optional—use only if lawful/desirable). Except small‑claims matters, disputes will be resolved by binding arbitration on an individual basis in Bangkok; class actions/jury trial waived where permitted.
15) Changes to Terms
We may update these Terms from time to time and will notify members of material changes via email/app or by posting on our website with an updated effective date. Continued use after changes take effect constitutes acceptance.
16) General
Severability; No waiver; Assignment (we may assign; you may not without consent); Entire agreement (these Terms, Gym Rules, Membership Agreement/Contract, Privacy Policy, and any addenda).
Schedule A — Gym Rules (House Rules)
Respect & safety: Follow coach directions; tap early; no unsanctioned hard sparring.
Hygiene: Clean gi/rashguard; shoes off mats; shower after training; do not train when sick.
Gear: Required for striking/sparring - mouthguard, 16oz gloves for heavy sparring, shin guards, headgear (as directed), groin & chest protection (as appropriate).
Clean mats: Disinfect equipment; report spills/blood immediately.
Personal items: Use lockers; no valuables on mats.
Minors: Parent/guardian must remain on site for [under 14] unless approved; no unsupervised children on mats.
Prohibited: Bullying, harassment, hate speech; weapons; illegal drugs; outside coaching for pay; filming without consent.
Emergency: Stop training for injuries; alert staff; follow evacuation instructions.
Animals: Only verified service animals permitted, kept off mats.
